Retribution and the value of victims of crime- Florian Zimmermann (FB Philosophie, UNI Konstanz)
Procedures for achieving reconciliation and democratic peace in societies under stress- Valentin Gold (and ?) (FB Politik und Verwaltungswissenschaft, UNI Konstanz)
Here are the ideas I wrote down because I considered them to be interesting in Mr. Florian Zimmermann´s lecture:
- how relevant is the victime´s perspective in the retributive system?
- crime victims should be in focus
-degrees of punishment
-the punitive position influences other people´s life
-after the punishment the conflict with the perpetrator is disposed of
-why should the public interest count and not that of the immediate victim?
-which is the relevant perspective on crime victims?
-the victim victim perspective should be rationally and morally relevant
-the humiliation cannot be disposed of in a simple material way
-insulting and degrading attitudes towards the victim of the attempted or completed murder
-struggling for vindication, some victims would refuse consolation or pity, they want to hav their value as human beings re-established
-a subjection of the offender by the victim should restore the previous position between them two (here I wrote down "examples?")
-reassertion of values- one of the victim´s needs in the retributive theory
-important issue: what if the victim does not feel humiliated by the offensive act?
-administration of punishment towards the offender can be aimed at adopting the victim experience
-objective value description: equal dignity of the citizens is constitutionally stated, retribution is implied
-an investigation against infringements from all sides
One of the questions raised by the guest auditors or other active participants belongs to a political science researcher. He challanged the perspective which focuses on reestablishing the previous status. The leveling down of the perpetrator or the leveling up of the victim are dangerous or risky things. Not only because it requires a special "apparatus". The subjection of the victim by the offender would be equated with the subjection of the perpetrator by the victim. I hope I understood correctly this disputed argument.
It is also necessary for me to mention that I have little knowledge of the way in which Truth and Reconciliation Commissions in South Africa and other countries which experienced deep unrest really worked. For me the lecture held by Mr. Florian Zimmermann had a strong connection with academic fields such as: law, social psychology, sociology, political sciences. But that´s exactly the reason why I wrote down some things which triggered my attention.
If I am able to get a copy of the presentation or a simple handout from Mr. Florian Zimmermann, I may also introduce new elements in the underlying discussion I just mentioned.
